About these terms

These Terms and Conditions ("Agreement") describe the terms under which services are provided by Pheonix Solutions ("Company", "we", "our", or "us") to customers, clients, and users ("Customer", "you", or "your"). These terms apply to all products, services, infrastructure platforms, development services, hosting environments, DevOps services, cloud infrastructure services, domain registration services, and other related digital services operated or delivered by Pheonix Solutions. By accessing the Company's website, purchasing services, creating an account, requesting technical services, or otherwise using services provided by Pheonix Solutions, it is acknowledged and agreed that the terms contained in this Agreement are accepted and will govern the relationship between the Company and the Customer.

Our services

The services provided by Pheonix Solutions may include but are not limited to shared hosting services, virtual private server hosting, dedicated server hosting, email hosting services, domain name registration services, DevOps engineering services, infrastructure management, software development services, monitoring services, server administration services, consulting services, and other technology-related services that may be offered from time to time. Services may be delivered through the Company's infrastructure platforms, development teams, engineering teams, support teams, or through trusted third-party infrastructure providers used to maintain service availability and performance.

Accounts

Customers may be required to create an account in order to access certain services provided by Pheonix Solutions. During the account registration process, customers may be required to provide accurate information including but not limited to name, company name, email address, billing details, contact information, and payment details. Customers agree that all information provided during account creation or service purchase must be accurate, complete, and up to date. Failure to provide accurate information may result in suspension, restriction, or termination of services. Customers further acknowledge that they are responsible for maintaining the confidentiality of their account credentials including usernames, passwords, access tokens, and authentication keys associated with their account.

Acceptable use

Services provided by Pheonix Solutions may be used only for lawful purposes and in accordance with applicable laws and regulations. Customers agree not to use the Company's services for activities that may be illegal, harmful, abusive, fraudulent, or disruptive to infrastructure operations. Prohibited activities may include but are not limited to the distribution of malware, unauthorized system access, denial of service attacks, phishing activities, spam transmission, intellectual property violations, or any activity that may compromise the security or integrity of infrastructure systems. Pheonix Solutions reserves the right to investigate suspected violations and may suspend or terminate services if activities are detected that violate these Terms and Conditions or applicable laws.

Service divisions

Pheonix Solutions operates multiple technical divisions responsible for delivering specialized services to customers. These divisions may include hosting infrastructure operations, DevOps engineering teams responsible for automation and infrastructure deployment, and software development teams responsible for delivering custom software solutions. Customers who engage Pheonix Solutions for software development services acknowledge that project information may be processed by the Company's engineering teams during the design, development, testing, and deployment phases of a project. Project information may include system requirements, architecture documentation, technical specifications, testing results, deployment scripts, and related development artifacts necessary for delivering software solutions. Such information may be used exclusively for the purpose of providing the requested development services unless otherwise agreed through a separate contract or confidentiality agreement.

DevOps and infrastructure services

When DevOps services or infrastructure management services are requested, the Company may configure infrastructure environments, deployment pipelines, monitoring tools, container platforms, or other automation systems required to maintain operational reliability. Operational data generated through these environments may include deployment logs, infrastructure metrics, monitoring alerts, and system diagnostics. Such information may be processed by DevOps engineers for the purpose of ensuring that applications remain stable, secure, and scalable in production environments. The Customer acknowledges that such operational data may be necessary to maintain service performance and security.

Payment

Payment for services provided by Pheonix Solutions must be made in accordance with the pricing structure published on the Company's website or specified in individual service agreements. Payment may be required in advance for hosting services, domain registration services, infrastructure services, or development services depending on the nature of the service being provided. Payment methods accepted may include credit cards, debit cards, electronic payment systems, bank transfers, or other payment methods supported by the Company. Customers agree that all service fees must be paid in full before services are provisioned unless otherwise specified in a written agreement.

Late payment and suspension

Failure to make payment for services when due may result in suspension or termination of services. If payment remains outstanding for an extended period, the Company reserves the right to suspend account access, disable infrastructure resources, or terminate services associated with the account. Customers acknowledge that suspended services may result in loss of access to infrastructure systems, hosted data, domain services, or other service components. Restoration of services after suspension may require payment of outstanding balances and applicable administrative or reactivation fees.

Hosting services

Hosting services provided by Pheonix Solutions may include shared hosting, virtual private servers, dedicated servers, or cloud infrastructure environments. Customers acknowledge that hosting infrastructure is provided as a service and that service availability may be affected by factors beyond the Company's control including network outages, third-party infrastructure failures, security incidents, natural disasters, or other unforeseen technical issues. While efforts are made to maintain high levels of service availability, the Company does not guarantee uninterrupted service operation. Scheduled maintenance may occasionally be required in order to maintain system performance, security updates, or infrastructure upgrades.

Backups

Customers who use hosting services are responsible for maintaining backups of their data unless a managed backup service has been explicitly included in the hosting plan. Although the Company may implement backup systems within its infrastructure environment, the Company does not guarantee that customer data can be recovered in all circumstances. Customers are therefore encouraged to maintain independent backup copies of critical data stored within hosted environments.

Domain registration

Domain registration services provided by Pheonix Solutions are subject to policies established by the Internet Corporation for Assigned Names and Numbers (ICANN) and the relevant domain registry operators. Customers who register domain names through the Company agree to comply with ICANN regulations and registry policies governing domain registration. Domain names are registered for limited periods and must be renewed prior to their expiration date in order to maintain ownership. Failure to renew a domain name before expiration may result in loss of the domain registration. The Company may send renewal reminders; however, the responsibility for monitoring domain expiration dates remains with the customer.

Software development projects

Customers who purchase software development services from Pheonix Solutions acknowledge that development projects may involve multiple phases including planning, design, development, testing, deployment, and maintenance. Project timelines may vary depending on project complexity, scope changes, or technical dependencies. While efforts are made to deliver projects within estimated timelines, the Company does not guarantee exact completion dates unless specified within a formal service agreement. Customers agree to provide timely feedback, approvals, and necessary information required for the completion of development projects.

Intellectual property

Intellectual property rights associated with software developed by Pheonix Solutions may be governed by separate contractual agreements depending on the nature of the project. In general, software developed specifically for a client may be licensed or transferred according to the terms specified in the development agreement executed between the Company and the customer. Unless otherwise specified, the Company may retain ownership of proprietary tools, development frameworks, libraries, and methodologies used during the development process.

Third-party providers

Pheonix Solutions may use third-party infrastructure providers or technology platforms in order to deliver services efficiently. Such providers may include cloud infrastructure vendors, domain registries, payment processors, monitoring systems, or software distribution platforms. The Company is not responsible for outages, failures, or service interruptions caused by third-party providers beyond its direct control.

Suspension and termination

The Company reserves the right to suspend or terminate services at its discretion if activities are detected that may threaten infrastructure security, violate applicable laws, breach service agreements, or cause harm to other customers or infrastructure systems. In such circumstances, services may be suspended without prior notice where necessary to protect infrastructure integrity.

Limitation of liability

Limitation of liability applies to all services provided by Pheonix Solutions. Under no circumstances shall the Company be liable for indirect, incidental, consequential, or special damages including loss of profits, loss of business opportunities, data loss, or service interruptions resulting from the use or inability to use services provided by the Company. The maximum liability of the Company for any claim arising from services provided shall not exceed the total amount paid by the customer for the specific service during the twelve months preceding the claim.

Indemnification

Customers agree to indemnify and hold harmless Pheonix Solutions, its employees, engineers, contractors, partners, and affiliates from any claims, damages, losses, liabilities, costs, or legal expenses arising from the customer's use of services in violation of applicable laws, service agreements, or third-party rights. This indemnification obligation shall survive the termination of services.

Changes to these terms

These Terms and Conditions may be updated or modified periodically in order to reflect changes in services, legal requirements, or operational practices. Updated versions of the Terms and Conditions may be published on the Company's website and may become effective upon publication unless otherwise specified. Continued use of services after the publication of updated terms constitutes acceptance of the revised terms.

Governing law

These Terms and Conditions shall be governed by applicable laws and regulations relevant to the jurisdiction in which the services are provided or operated. Any disputes arising from the use of services provided by Pheonix Solutions shall be resolved through appropriate legal channels or dispute resolution procedures in accordance with applicable laws.

Entire agreement

By using services provided by Pheonix Solutions, it is acknowledged and agreed that these Terms and Conditions constitute the complete agreement governing the use of services offered by the Company and supersede any prior agreements, communications, or understandings related to such services.
